Widower sues restaurants for wife's death in drunk-driver accident

The estate of a woman who died on her wedding night has reached an agreement with certain establishments that catered to the drunk driver involved in the crash that killed her, according to court documents filed Friday. The consent petition says Samantha Miller's estate has reached an agreement with The Crab Shack, The Folly Deli and Progressive Northern Insurance Company under which they will pay "certain amounts" under the Wrongful Death Act and the Survivorship Act in exchange for a release of liability for the accident in April that left the bride dead.

Miller died in a car accident hours after her wedding ceremony in South Carolina, where she married Aric' 'Hutchinson, who is the representative of the estate and the sole beneficiary. The petition also states that the settling defendants will pay attorneys' fees of 33 and one-third percent of the settlement.

Other defendants, including Jane Komoroski's driver, other Folly Beach restaurants and an unidentified probation officer, as well as several individuals named John and Jane Doe, were not named in the petition.

Komoroski faces charges including reckless vehicular homicide and driving under the influence of alcohol with serious bodily injury.

From a memorable night to tragedy

The head of Folly Beach's public safety department, Andrew Gilreath,' 'told USA TODAY that Hutchinson and Miller had been married just hours before the crash.

Police Officer Folly Bicha, who arrived on the scene, said the driver of the Camry smelled strongly of alcohol and admitted to having "one beer and a tequila drink about an hour ago."

Police said evidence from Komoroski's rental car showed she was traveling 65 mph and briefly applied the brakes before crashing into the golf cart.

Komoroski refused to take a field sobriety test and a breathalyzer test, according to her arrest affidavit. She was arrested and medical personnel drew her blood for testing. According to additional court documents, when the blood was drawn, her blood alcohol level was 0.261, which' 'exceeds three times the legal driving limit.

"Despite the fact that she was visibly and obviously intoxicated at each of these establishments," the lawsuit says, "Jayme Komoroski continued to obtain and consume alcoholic beverages. "
