Federal prosecutors say a Georgia real estate agent made a sex video of a professional athlete without his consent.

Prosecutors allege the agent sent text messages demanding $250,000 and threatening to leak the video.

The complaint alleges the athlete cooperated with the FBI to set a trap.

According to court documents, Marvavier real estate agent Ryan Herts of Atlanta, Georgia, was accused of trying to blackmail a professional athlete after illegally recording their sexual encounter.

According to a criminal indictment charging Herts with three counts of interstate communications for blackmail, between June and July, a real estate agent and an athlete whose identity is protected in court documents had sex at a hotel where Herts recorded it without his permission, federal prosecutors allege.

Some days later, Hurts began blackmailing the athlete, prosecutors allege.

Hearts' attorney has not yet responded to Insider's request for comment.

For months, Herts pressured the athlete to send him $250,000 to protect information about his sexual history and prevent the video from being released, promising to sign a nondisclosure agreement in return, until the athlete flew to New York and worked with the FBI to develop a plan to track Herts, the complaint alleges."I know too much about you. During June and July, Hurts continued to text the athlete and sent him Instagram messages, prosecutors allege.

On June14, he sent a message to the athlete's sister, asking her to pressure him to accept his offer, according to court documents.

Prosecutors also said Herts tried to dissuade the athlete from contacting law enforcement, telling him that any legal documents would reveal his identity.

Then the FBI and the athlete devised a trap to get Herts involved, the athlete traveled to New York and finally responded to Herts' numerous messages, allowing investigators to use the location warrant, opening the door for prosecutors to investigate interstate blackmail charges, according to the complaint.

The athlete then began asking Herts to send his bank account information so he could wire him money, while Herts insisted on payments via CashApp or cash.

"Send your bank account information so I can wire money," the athlete wrote to Herts on July 7. "I don't trust you. As you are to me.".

Thanks to the bank account information, the FBI was able to confirm Herts' identity and later apprehend him in Georgia.

No guilty pleas have been entered yet.
