A new filing reveals when Jack Smith will begin his lawsuit against Trump.

In February 2024, special prosecutor Jack Smith said he would like to begin the trial of former President Donald Trump on classified documents on July 8, 2024, according to a recently released statement. Smith intends for the trial to begin well before the 2024 presidential election, while attorneys representing the former president and likely Republican nominee for that year believe the trial should begin after Election Day. Smith is leading the investigation into Trump's alleged mishandling of classified documents and is also probing Trump's role in the events that took place at the U.S. Capitol on Jan. 6, 2021.

However, Trump's lawyers said in a legal filing that Trump "categorically argues that a fair trial cannot be held this year under the Constitution" regarding his right to attend the trial and his right to run for president. Still, Trump's team has proposed Aug. 12 as the start date for the trial, according to documents.

The former president faces 41 charges for allegedly mishandling hundreds of classified documents that federal agencies found at his Mar-a-Lago estate in Palm Beach, Florida.
