The father of a deceased UGA player is suing the athletic association and Jalen Carter for $40 million.
The father of a University of Georgia soccer player killed in a car accident in January filed a lawsuit Tuesday against the University of Georgia Athletic Association, a former UJ soccer star and several other defendants. Devin Willock and recruiting analyst Chandler LeCroy were killed in a Jan. 15 crash that occurred hours after the soccer program's championship parade in Athens. Recruiting analyst Victoria Bowles and offensive lineman Warren McClendon survived the crash.
Channel 2's Tom Jones obtained a copy of the lawsuit filed in Gwinnett County and spoke with Father Willock's attorney for Channel 2 Action News at 6 p.m. The lawsuit names the UJ Association and several of its employees, LeCroy's legacy, former UJ star Jalen Carter, Sarchione's Auto Mall and Toppers International strip club.
Police in Athens say LeCroy was driving the SUV that crashed. The lawsuit shows that Carter was driving with a suspended Florida driver's license and was chasing an SUV driven by LeCroy at speeds in excess of 100 miles per hour before the crash. The University Athletic Association leased an SUV driven by LeCroy. Carter pleaded guilty to misdemeanor charges related to the crash and is on 12 months probation.
Father Dave Willock and Willock's legacy are seeking $30 million in compensatory damages from the defendants and an additional $10 million in punitive damages from Carter, according to documents.
Attorney William Stiles, who represents Willock's father, said the purpose of the lawsuit is to establish liability and ensure similar tragedies don't happen again in the future. He stated that LeCroy and Carter should not have been behind the wheel, and the University Athletic Association of the University of Georgia knew that. "The association should have taken steps to make sure she was not actually driving the car," Stiles said, arguing that LeCroy had a history of speeding violations.
Stiles said Carter's penalty for his involvement in the crash should have been more severe.
Stiles said there is no money in the world to pay for the loss of a child. "When I say he's broken and desperate, that's too soft an expression," Stiles said. Channel 2 Action News reached out to the Athletic Association for comment and received the following statement prior to the Channel 2 Action News broadcast at 6 p.m.
"The attorneys who filed the lawsuit have refused to provide any factual basis for their claims against the Athletic Association, and we believe the evidence will support their lack of merit. We intend to vigorously refute these baseless allegations in court. "
Jones also contacted the other parties named in the lawsuit but did not receive a response.
The lawsuit filed against the athletic association is separate from possible legal action against the University System of Georgia. Dave Willock's attorney presented a note ante litem, dated April 11, to the Board of Trustees. According to the ante lite note, Willock will sue for $2 million for funeral, burial and medical expenses, as well as "physical and mental pain and suffering resulting from his son's injuries from the collision" before his death.
In a note, the attorneys wrote that the UJJ Association and LeCroy's legacy could be subject to a separate lawsuit from the panel. The father of a University of Georgia soccer player killed in a car crash plans to sue the university.
