A judge from Georgia has scheduled hearings to consider the issue of overturning Trump's free speech case.
A Georgian judge has scheduled a hearing for Thursday to consider the possibility of dismissing the conspiracy case against Donald Trump on First Amendment grounds. On Monday, Fulton County Superior Court Judge Scott McAfee set the hearing for March 28. McAfee is expected to review motions from Donald Trump and other defendants in the election interference case.
Trump's motion asked the court to dismiss the case based on his First Amendment right to free speech. McAfee rejected two similar motions from the respective defendants Kenneth Chesebro and Sidney Powell.
According to the Atlanta Journal-Constitution, Trump would have to admit that his claims about rigging the 2020 election were false in order to assert First Amendment protections. The Fulton County case centers on attempts to change the results of the election in which Trump was defeated by Democrat Joe Biden. Specifically, officials in Georgia, including Fulton County Prosecutor Fanie Willis, analyzed a number of actions and communications by Trump and his allies aimed at influencing the state's elections.
The decisive moment in the investigation was the call made by Trump in January 2021 to Georgia Secretary of State Brad Raffensperger. During this call, Trump urged Raffensperger to "find" enough votes to overturn Biden's narrow victory in the state.
