** In France, there are three different types of real estate sales contracts.

  • "Simple sales agreement (mandat simple)"...
  • Semi-exclusive sales agreement (mandat semi-exclusif)It allows the real estate agent to have exclusivity (meaning you cannot list your property with other agents), but you retain the right to sell your property on your own. This can be a beneficial situation for you, as you can either use the help of the real estate agent for the sale or sell the property yourself without the associated commission fees. However, be very careful when reading the contract if you choose such an agreement. In particular, make sure there are no clauses in the contract regarding commission fees that must be paid to real estate agents in the case of a private sale. You should also ensure that potential buyers do not visit the property through the real estate agent. If a buyer has already visited the property and signed an agreement (bon de visite), which essentially prohibits the buyer from negotiating directly with the seller on the price, you will not be able to legally sell the property to that buyer without going through the agent and paying the associated commission.
  • Exclusive sales agreement (mandat exclusif)It provides the real estate agent with full exclusivity, which means you cannot list your property with other real estate agents or advertise it for sale on your own.

Even if you find a buyer yourself, they will still be required to go through the real estate agent and pay the appropriate commission. While this option is the most restrictive, it has some advantages. An exclusive agreement can be signed for a maximum term of three months, and you can also negotiate a shorter contract, such as one month, making it a great choice if your priority is a quick sale. The combination of a limited time frame and the terms of the exclusive contract usually means that the real estate agent will be highly motivated to sell your property as quickly as possible. Note that the exclusive agreement cannot be extended - it is only for three months. Of course, nothing prevents you from entering into a new contract if you wish, but it will be a new agreement.
