Kim Zolciak and Kroy Bierman struggle with the devastating mortgage process.

The couple Kroy Biermann and Kim Zolciak-Biermann are doing everything they can to prevent a lien on their shared Georgia mansion.

According to documents obtained by Us Weekly magazine, the couple each filed depositions on Oct. 25, where they describe what the consequences of a lien would mean for their family. The couple put their home up for sale earlier this month after Us confirmed in February that the property was in foreclosure.

The impact of the lien on the family

"The consequences of losing this property will be devastating to my family, including myself, my former spouse Kim and our four minor children," Biermann, 38, wrote in his deposition. "We will be left homeless, without financial resources, and unable to resolve debts accumulated during our marriage. Those debts include a Truist mortgage, a home equity line of credit (HELOC) and an Internal Revenue Service (IRS) lien. "

Biermann noted that he "worked closely with Truist" to avoid the lien, entering a "3-month probationary period from June through August 2023." However, he and Zolciak-Biermann, 55, were unable to make a payment in August due to "difficulties arising from the ongoing divorce," and that prompted the holding company to file a lien.

Biermann emphasized that the property is currently on the market "pursuant to a court order" from the judge hearing the divorce case. The sale will ensure that the debt to Truist can be paid in full.

For her part, Zolciak-Biermann said in her deposition that she and Biermann "will face insurmountable financial hardship" because of the lien and added that "the most devastating impact will be on our children, who will be left homeless." (The couple has sons Kroy Kai, 12, Cash, 11, and twins Kaia and Kane, 9.

Zolciak-Biermann is also the mother of daughters Brielle, 26, and Ariana, 22, from previous relationships).

Petition against Truist

"We are asking for your support to expedite the sale of the home subject to a temporary court order to prevent a lien," continued Zolciak-Biermann, a member of Real Housewives of Atlanta.

The petition filed by the former spouses against Truist says their home "should be sold at auction on the courthouse steps on November 7, 2023." The petition states that "if the lien is allowed, the petitioners will suffer incurable damage to the marital estate, completely depleting it. "

Divorce and legal disputes

Zolciak-Biermann and Biermann initially filed for divorce in May, but briefly reunited two months later before separating again in August.

Biermann said in court documents obtained by Us magazine last month that he has "no desire to reconcile" with Zolciak-Biermann, despite the fact that they have maintained an intimate relationship since their breakup. He added that he "remains firm in his desire to leave Zolciak-Biermann, to leave the joint residence with the children and provide them with a calm and stable home, unlike their current environment. "

A source close to Zolciak-Biermann told Us magazine that she "had no choice" but to skip the September divorce hearing because she was overseas filming the show The Surreal Life. According to the source, Zolciak-Biermann "had to make money" because she and Biermann are "broke." She later tried to sell designer Biermann's shoes on social media.

This month, Zolciak-Biermann filed paperwork with the court seeking primary physical custody of their four minor children and asked to share joint custody with Biermann.

The couple's legal proceedings continue when they were ordered to pay nearly $230,000 to Simmons Bank after failing to respond to its final default order following a lawsuit filed in July regarding a home mortgage line of credit on which they were unable to pay. An earlier temporary order granted them "exclusive use" of their mansion until it is sold, with Zolciak-Biermann staying in the "basement/nanny room" and Biermann occupying the master bedroom.
