Judge David Friedman of the New York State Intermediate Appellate Court overturned the ban on Trump's speech. Friedman acknowledged that the ban contradicts the freedom of expression enshrined in the Constitution and noted that it is not appropriate for a judge to control the statements of a candidate for one of the strongest positions in the2024 presidential election, made outside the courtroom.

While the lengthy appeals process regarding the final fate of the performance ban continues, Judge Friedman allowed Trump to freely express his views on the court personnel in the context of the real estate fraud case.

In the legal case of real estate fraud ongoing in the Manhattan court since October2nd, Judge Arthur Engoron has imposed a gag order on speaking about court personnel after Trump posted a message on his social media account. For violating the "gag order" imposed on October3rd, Engoron fined Trump $15,000.

Trump's lawyers appealed to the New York appellate court for an immediate halt to the proceedings related to the gag order. Trump's lawyers argued that Judge Engoron "abused his authority," while Engoron maintained that the gag order was implemented for the safety of court personnel.

New York prosecutor Letitia James stated in the indictment that Trump inflated the income of his three children and his company by $3.6 billion, and demanded that the judge prohibit Trump and his children from creating companies in New York, prohibit the purchase of commercial real estate for5 years, and impose a penalty of $250 million.

In a case related to allegations of real estate fraud, Judge Arthur Engoron found that former President Trump and his company, the Trump Organization, inflated asset values and exaggerated net worth in contracts and financing documents to secure loans and lower insurance premiums. Trump claimed that the case against him was initiated for "political reasons," while Trump's lawyers appealed to the New York appellate court against Engoron's ruling, in which he found Trump and other defendants guilty of fraud.

In their complaint, the lawyers requested an analysis of whether Judge Engoron had committed "legal and/or factual errors, abused his powers, and/or exceeded his authority."
